Stock brokers liability towards investor in the bourse | ||

| Abstract | ||
| Iraqi legislator organizes dealing with stocks in bourses by private rules, among them these, which forbid dealing with stocks directly between the seller and purchaser. And impose to deal via authorized and registered broker in the bourse; otherwise the dealing will be invalid. And if the investor has to deal with the broker, then he will need a legal protection to his interests, in the case of misconduct by the broker. And one of the means to protect investor the legal liability of broker towards the investor. This liability subjects mainly to the general rules of civil liability, but these rules are not sufficient in many cases to protect the investor because of the special legal position of both the investor and broker. Elaboration of these rules and revealing its lack and shortage and suggestion of substitute suitable rules is the aim of this research. | ||
