| يهدف البحث الى مدى عناية الشريعة الإسلامية بالمرأة واثبات حقوقها الزوجية وبخاصة في حالة الطلاق التي تحتاج في المرأة الى الرعاية الخاصة بسبب ذلك لما يصيبها من وحشة الطلاق وآثاره النفسية عليها . فأوجب التشريع الإسلامي (متعة الطلاق) وقد ترك امر تقديرها الى الحاكم وبحسب تغير الظروف الاجتماعية و الاقتصادية وحالة الزوج المادية فجعلها تشريعا صالحا لكل زمان ومكان . This research aims to shed light on how Islamic legislation took care of women her maternal right (divorce in particular) where the woman needs special care, and the consequences of lone some and other psychological effect. Thus, Islamic legislation, viewing all that, prescribed (divorce allomany) to be valued by the governor, and adapt such legislation to fix every time every place, the various social and economic circumstances and the financial capability of the husband. | ||
