| هذه رسالة في الفقه الحنفي للإمام حسن بن عمار الشرنبلالي بعنوان: ((الإقناع في الراهن والمرتهن إذا اختلفا في الرد ولم يذكر الضياع)). دارت فكرة الرسالة في مسألة: إذا اختلف الراهن والمرتهن في رد الرهن فهل القول للراهن أم للمرتهن وشمل المحاور التالية:1. المواضع التي تكون القول فيها للراهن.2. المواضع التي تكون فيها القول للمرتهن. 3. الرهن أهي أمانة في يد المرتهن أم عارية مضمونة.قمت بتحقيقها مقارنا بين نسختين خطيتين معتمدا على كتب أئمة المذهب وخرجت بنتائج ثبتها في آخر البحث.This paper, titled ((Explaining the case in which the mortgagor and the mortgagee dispute about the return of the mortgage without mentioning the loss)), is in Al-Hanafi fiqh by Al- Imam Hassan bin Ammar Al-Shranbilali.The idea of this paper is about the case when there will be a dispute between the mortgagor and the mortgagee over the return of the mortgage and which one of them has the right. The paper comprises the following points:1. The cases in which the mortgagor has the right.2. The cases in which the mortgagee has the right.3. Is the mortgage a trust with the mortgagee or a guaranteed loan?I have examined this paper comparing two handwritten copies relying on the books of the school's (Madhhab's) Imams and I have made some conclusions. | ||
