Abstract
إن الأحكام شرعت لتنظيم حياة الإنسان فردا في جماعة وجماعة في مجتمع، ومهما امتد الزمان واختلف المكان ظهر فضل الإسلام وأهميته لكل زمان ومكان لذا كان خاتم الكتب السماوية القران الكريم الذي فيه تفصيل لكل شيء ، ومنها اثر الأحكام والقضاء الشرعي في بناء المجتمع أخلاقيا وإنسانيا والنهوض به للترقي إلى مدارج الاستقرار الاجتماعي والاقتصادي،فقد أحاطت الشرعية الغراء بالقاضي لانه داعية الله في الأرض فكانت هناك أسس وحصانات فقهية يظهر فيها هيبة القضاء ومكانته في حياة المكلفين .وقد بني البحث على تمهيد وضح فيه تعبير (حكم وقضى) (لحُكْم ولحُكْم) لغتا واصطلاحا. وشمل البحث على ثلاث اقسام. يضم القسمَ الأول فيه (حصانة القضاء الشرعي الذاتية) والذي نعالج فيه الخصائص الأكثر أهمية في الإسلام أما المحورالثاني فقد شمل على حصانة القاضي (الإعداد والتنظيم الداخلي للقاضي) وفضلا عما سبق فقد شمل القسم الثالث على حصانة القضاء (مجلس القضاء) والتي تطرقت الى ثلاث مسائل وهي الحصانة الجغرافية والعمرانية وحصانة الترشيح للقضاء وحصانة القضاء في المحظورات. وأخيرا ، ينتهي البحث ببعض الاستنتاجات المهمة ، والاقتراحات الحديثة والمصادر .Islamic rules had been legislated to organize the life of both, the individual within a group, and the group within a society. The goodness and importance of Islam always emerge in different times and places, however the final Divine Book, i.e. The Holy Qura’n includes heavily the details of everything, among which the clear impact of Islamic rules and instructions in building the society at both levels, the moral and human. Also the Islamic judiciary aims apparently to achieve the renaissance of the societies socially and economically, and grants the judge the ability to be as announcer of Islam on this earth, therefore there were bases and impregnabilities in Islamic jurisprudence in which the solemnity and the position of judiciary apparently emerge in the individuals, lives. On the basis of the little of the conference and the field of Islamic sciences, this research is entitled “The Basis of Juristic Immunity of the Contemporary Judge” (The Independence if the Judge). The research relies on an introductory to highlight the semantic notion of the expressions (حكم وقضى) (to rule and to judge) linguistically and terminologically. The research includes three sections. The first section is entitled (The self Immunity of Islamic Judiciary) in which we tackle the most important characteristics of Islamic or what is called the interval organization of the judge. This section includes three issues: the self immunity of the judge, the social, moral, and economic immunity. In addition to the judicial immunity. The third section is entitled (The Immunity of Judiciary). It involved three aspect: the geographical and constructional immunity, the immunity of nomination and judicial qualifications and the immunity of judiciary in banned aspects. Finally, the research ends with some important conclusions, modern suggestions and a bibliography.
