This thesis is about a thing that may happen in a certain time or a certain status, and is doubtful to keep on after that. It is about the judicial adjudication regarding things that are not correlated with it, or having something stating its constancy.
This thesis is divided into two parts:
The first deals with what regards the juridical adjudication, like establishment of the nonentities.
The second deals with taking the same judicial adjudication which is of two kinds: to prove the judicial adjudication for a known subject.
The second kind is about a known a subject which doesn't arouse any suspicion.
The following steps were followed for achievement:
1- choosing the thesis: it is a short one, from one hand, and was written by a great a great man like Al-Bahbahani on the other. So, it is important to prove that this thesis is for Al-Waheed Al-Bahbahani .
2- We are not yet sure whether the thesis has been investigated.
3- Searching for the different copies of the thesis: at the beginning we have got a copy from the library of Al-Fiqh College, then we found a copy in Kashif elGhitaa library, which the same as the one belonging to the library of Al-Fiqh College, then we found two different copies of the thesis in Ameer elMu'mineen library.
4- Copying the thesis from manuscripts, reading the ambiguous words, and making comparisons among the copies, fixing the punctuation marks as known nowadays.
5- Making conformity of the copies, to show and clarify the differences so as to fix the most correct and specified copy, then putting the differences in apostils.
6- Confirming that the thesis was written by Al-Waheed Al-Bahbahani . This will be included in the introductions which we have written in this study.
7- Write a biography of Al-Waheed Al-Bahbahani, and show his role in developing the Isolian Imamian School, it will be shown in the introductions.
8-Confirming the differences among the copies in apostles using the following symbols:
a) The copy of Al-Fiqh College, and the copy of Kashif elGhitaa library.
b) The copy of Ameer elMu'mineen the first library.
c) The copy of Ameer elMu'mineen the second library.
We have made the copy of b) as the original one and made some necessary amendments according to a) and c) because b) was the reliable when we have made revisions.
We included the study a number of introductions which show the reader the value of the study and its writer. |
