| Abstract | ||
| system in erecting justice, pushing unfairness and punishing criminals. - The prophet Mohammad Allah peace and prayers be upon him was the first judge in Islam by Allah command and he made the mosque his place of judging. - Pointing judges was restricted by the prophet at his ruling and Rashidies caliphs after him and this gave respect on the judge's personality and all were obeying his orders. - The judge was under full responsibility giving judgment away from Allah rules and judgment bases and when doing so he will be punished and gave his post away in addition to paying fine. -The judge will not be under any responsibility when unintentionally judging wrongly, in that he is acting for caliph, and the guarantee will be in Muslims (bait al- mal) as the opinion of the majority of Muslims emams and we support this opinion and Allah knows more. | ||
